These terms and conditions apply to ALL transactions made on or through this Website. This Agreement is intended to be governed by the Electronic Signatures in Global and National Commerce Act. By placing an order with us, you will be deemed to have read, understood, and agreed to these Terms and Conditions of Use (collectively, "Terms"). If you do not agree to be bound by these Terms, you may not access or use the Website, or purchase any Product(s) through the Website. By accessing, using or ordering Product(s) through the Website, you affirm that you have read this Agreement and understand, agree and consent to all Terms contained herein.
CONDITIONS OF USE
By ordering goods from Onyx Youth destined to EU-member states specifically, services will be provided to you only after you explicitly agree to become Importer of Record (“IOR”) and as such customs clearance shall be made in your name and on your behalf. As IOR, you agree to be ultimately responsible for importing the products ordered by you into the destination EU-member state and are solely responsible for the payment of duties, and taxes either at the time of sale if prepayment is selected or at the time of importation if prepayment is not selected. You hereby give a proxy or power of attorney (“POA”) to Onyx Youth designated shipping provider for the customs clearance of products ordered by you. This POA authorizes Onyx Youth designated shipping provider’s assigned customs broker to act on behalf of you. Onyx Youth designated shipping provider’s intervention with respect to customs formalities may be done by a customs agent assigned by Onyx Youth designated shipping provider on your behalf. You hereby acknowledge to have understood the concept of IOR and the need of the POA and further state that the terms of the POA or terms of the purchase from Onyx Youth and transportation conditions from Onyx Youth designated shipping provider are not unreasonable or unknown to you, that you have read them, understood them and further have agreed to them

WE RESERVE THE RIGHT, AT OUR DISCRETION, TO MODIFY, ADD, OR REMOVE PORTIONS OF THESE TERMS AND CONDITIONS AT ANY TIME AND EACH SUCH CHANGE SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING. MONEY BACK GUARANTEE

If you are not satisfied with a qualified item that you have purchased, you may return the item within 30 days from the order date for a full refund of the purchase price, minus the shipping and handling. Please Note: Onyx Youth cannot process or exchange packages marked "Return to Sender." To ensure that your account is correctly noted, you must send product back to the Onyx Youth returns department along with your RMA number. The RMA number must be clearly written on the package that you are sending back. Our shipping department is NOT allowed to accept any packages without an RMA number. We cannot issue refunds for Onyx Youth orders purchased from our subscription service (Replenishment kit) once the product has been shipped from our warehouse. We are not responsible for lost or stolen items. We recommend all returned items to be sent using a third party delivery confirmation system to ensure proper delivery.
EXCHANGES (IF APPLICABLE)
Products are only available for exchange if they are defective or damaged. Items available for exchange should not be used or opened, and in new condition with the tamper proof seals intact and not removed. If you need to exchange it for the same item, you may contact us at firstname.lastname@example.org or Tel: 1-888-408-7184 Monday-Friday 8:30AM-5PM, PST. You will be responsible for paying for your own shipping costs for returning the defective or damaged item back to us. Depending on where you live, the shipping time for your exchanged product to reach you may vary.
REFUNDS (IF APPLICABLE)
Once your return is received and inspected by our returns department, we will also notify you of the approval or rejection of your refund. If approved, your refund will be processed and a credit will automatically be applied to the payment method used to make your original purchase within 7-10 business days.
MISSING OR LATE REFUNDS (IF APPLICABLE)
If it has been more than 7-10 business days from the delivery of your returned package, first thoroughly check your bank account statement again. If you do not see it, then contact your credit card company or bank directly as it may take additional time for your refund to be posted to your account. In some cases, it may take longer than 7-10 days for your bank to post a refund. INCORRECT SHIPPING INFORMATION AND REFUSED PACKAGES
Orders are shipped to the exact delivery address entered into the website when the order is placed. It is the sole responsibility of the customer to provide a correct shipping address. If a package is returned due to an incorrect or incomplete shipping address provided by the customer, the customer, under our discretion, may be responsible for a returns processing fee of $10 as well the re-shipment cost equal to the cost of shipment for the order. If the package is refused and a refund is requested, the customer, under our discretion, may be responsible for a returns processing fee of $10 and a refund will be processed excluding any shipping and handling fee.
REPLENISHMENT KIT AUTO-DELIVERY PROGRAM
The Onyx Youth Replenishment Kit Auto-Delivery Program saves you time and money! Conveniently receive a single Replenishment Kit every month starting in 30 days from the date of your original order. By placing your order with the subscribe and save option you agree to be shipped 1 Replenishment Kit every 30 days, starting on the 30th calendar day from the date of your original order and every 30 days thereafter until cancelled. Each Auto-Delivery shipment will incur a monthly charge of $59.00 + FREE SHIPPING which will be automatically charged to the same payment method used to purchase your original order. There are no obligations and you may customize your order, change your shipping interval, skip or easily cancel shipments at any time by calling customer service at 1-888-408-7184 Monday-Friday 8:30AM-5PM, PST or by emailing firstname.lastname@example.org.
When we ship the Product to you, our Standard ground mail service is shipped via the combined services of UPS and USPS. With our Expedited Priority Processing Option (if available), we will make your shipment our priority and ship your package out the next day for all orders placed before 10PM PST (packages should arrive within seven to ten (7-10) business days. Please note that shipments are not sent out on Saturdays, Sundays, or any Holidays. We do not guarantee arrival dates or times. We do not refund or credit shipping charges for any monthly or bi-monthly shipments.
We are responsible for your new purchase until it reaches the carrier service you chose at the time of your order. In the case that your shipment is lost or damaged during transit, you are responsible for filing a claim with your carrier. We are not responsible for lost packages during transit to forwarding services or companies. If you place an order and your shipping address is a forwarding address, it is your responsibility to contact your forwarding company or service to locate your shipment. Additionally we are not responsible for weather related damage or delays to your order.
By ordering Onyx Youth Magnet Mask, you authorize Onyx Youth Magnet Mask to charge your credit card for the purchase amount of the product. This authority shall remain in effect until and unless you have cancelled future orders of the products as described in this Agreement. If you believe that you have been billed in error, please notify our Customer Care Department immediately.
You represent that you are at least 18 years of age and that you will not permit a person under 18 to order, or use, the Product. You represent that the information provided by you when placing your order is up-to-date, materially accurate and sufficient for us to fulfill your order in a timely and efficient manner. Unless agreed otherwise or required by applicable law, any warranties provided in relation to the Product only extend to you on the understanding that you are a user, and not a reseller, of the Product. You agree to pay for the Product and any taxes, shipping or handling of Product as such costs are specified by us on the Website when you submit your purchase order. Payment shall be made prior to delivery and by such methods as indicated on the Website (and not by any other means unless we have given our prior consent to such alternative payment methods).
By accessing this site, you agree to receive emails from us about product updates, promotions, and newsletters that we feel may interest or benefit you. We shall promptly notify you by electronic mail of any such claim or suit, and cooperate fully (at your expense) in the defense of such claim or suit. If we do not hear from you promptly, we reserve the right to defend such claim or suit and seek full recompense from you.
We reserve the right to terminate your access to or use of this Website and/or your subscription to the Product should we believe that you have violated any of the terms of this Agreement or if we believe you have sought, in bad faith, charge backs, credit backs, Product returns, discounts or any other conduct designed to injure, harass or disrupt this Website or the Company's business operations.
We reserve the right, but undertake no obligation, to actively report and prosecute actual and suspected credit card fraud. We may, in our discretion, require further authorization from you such as a telephone confirmation of your order and other information. We reserve the right to cancel, delay, refuse to ship, or recall from the shipper any order if fraud is suspected. We capture certain information during the order process, including time, date, IP address, and other information that will be used to locate and identify individuals committing fraud. If any Web Site order is suspected to be fraudulent, we reserve the right, but undertake no obligation, to submit all records, with or without a subpoena, to all law enforcement agencies and to the credit card company for fraud investigation. We reserve the right to cooperate with authorities to prosecute offenders to the fullest extent of the law.

How does the Afterpay payment schedule work?
All Afterpay customers are required to make their first payment at the time of purchase. Three remaining installment payments are deducted automatically from your selected payment method every two weeks. If you would like to make additional unscheduled payments before they are due, you may log in to Afterpay to make your payments early. Afterpay will then adjust your amount owed accordingly. You can log in to your Afterpay account anytime to view your payment schedule or make a payment before the next due date.
How do I use Afterpay?
Shop onyxyouth.com as usual — just choose "Afterpay" as your payment method at checkout, register with Afterpay and provide payment details (they accept Visa or Mastercard). If you’ve used Afterpay before, just log in to your Afterpay account and complete your order — it’s that easy! Can I use Afterpay if I’m an international customer?
Afterpay is only available to customers with a US billing address. Customers with international billing addresses will not be able to create an Afterpay account.
What if I can’t pay an Afterpay installment?
If funds are not available at the time an automatic payment is due, you will be charged an $8 late payment fee by Afterpay. When will my items be delivered if I use Afterpay as my payment method?

Is there a limit to how much I can spend on a single Afterpay transaction?
Yes; your order must be between $35 and $1000 to use Afterpay.
What products are not eligible for Afterpay?
Afterpay is not available on recurring Subscription orders. Afterpay is available on non-recurring purchases of all products available at Sand & Sky.
How do I refund or cancel an item purchased with Afterpay?
Afterpay refunds follow our standard refund process, as outlined below.
We will replace any damaged products if you return them within 30 days of purchase. Please contact us at: firstname.lastname@example.org to find out how to send damaged products back to our nearest warehouse, and we will process the replacement after they have been received.
